By accessing or using Lumafly ("we", "us", "our") — including our website at lumafly.app and our platform at app.lumafly.app — you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

We reserve the right to update these terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.

2. Description of Service

Lumafly is an AI-powered platform that enables brands and marketers to create highly realistic UGC-style video ads. Our platform provides tools for script generation, avatar selection, video editing, and ad production using artificial intelligence.

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

3. User Accounts

To access Lumafly, you must create an account. You are responsible for:

• Providing accurate and complete information at registration
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account

You must be at least 18 years old to create an account. By registering, you confirm that you meet this requirement. If you believe your account has been compromised, contact us immediately at ayush@lumafly.app.

4. Acceptable Use

By using Lumafly, you agree not to use the platform to create, distribute, or promote content that:

• Is illegal, fraudulent, or violates any applicable laws or regulations
• Is sexually explicit, obscene, or NSFW in nature
• Contains false, misleading, or deceptive claims about products or services
• Infringes upon the intellectual property rights of any third party
• Harasses, defames, or harms any individual or group
• Attempts to reverse-engineer, scrape, or misuse our platform or AI systems

You are solely responsible for the content you input into and generate from the platform. Lumafly reserves the right to remove content and terminate accounts that violate these terms.

5. Intellectual Property

Your content: You retain full ownership of any content you upload to the platform (images, videos, scripts, etc.) and of the AI-generated ad outputs produced using your inputs. By uploading content, you grant Lumafly a limited, non-exclusive licence to process that content solely for the purpose of delivering the service to you.

Our platform: All software, designs, trademarks, and technology underlying the Lumafly platform remain the exclusive intellectual property of Lumafly. You may not copy, reproduce, or create derivative works from any part of our platform without prior written permission.

6. Payment and Billing

Access to certain features of Lumafly requires a paid subscription or one-time purchase. All payments are processed securely through our third-party payment provider.

• All prices are listed in USD unless otherwise stated
• Subscription fees are billed on a recurring basis (monthly or annually, depending on your plan)
• All purchases are final — we do not offer refunds
• You are responsible for any taxes applicable to your purchases

We reserve the right to change our pricing at any time. We will provide reasonable notice before changes take effect for existing subscribers.

7. Termination

We reserve the right to suspend or permanently terminate your account immediately and without prior notice if you violate these Terms of Service, engage in fraudulent activity, or use the platform in a manner that harms other users or Lumafly.

You may also terminate your account at any time by contacting us at ayush@lumafly.app. Upon termination, your right to access the platform ceases immediately. No refunds will be issued for any remaining subscription period.

8. Disclaimer of Warranties

Lumafly is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

We make no guarantees regarding the quality, accuracy, or performance of AI-generated outputs. You use the platform at your own risk and are solely responsible for how you use any generated content.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Lumafly and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the platform.

In no event shall our total liability to you exceed the amount you paid to Lumafly in the 12 months preceding the claim.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be subject to binding arbitration.

11. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you via email or through a notice within the platform. Your continued use of Lumafly after such notice constitutes acceptance of the updated terms.
